The occupational health and safety action plan is statutory.
According to the Occupational Safety and Health Act, every employer must have an occupational safety and health action plan. It must include:
needs for developing working conditions
the impact of working conditions on the health and safety of workers
objectives and means derived from the above to promote health, safety and work ability.
The principle of the Occupational Safety Act is proactive occupational safety and continuous improvement of working conditions. Documentation is an essential part of the daily management of occupational safety. Anticipation also requires the identification and assessment of hazards. Carefully prepared work instructions and risk assessments are essential to the comprehensive management of occupational safety.
Legal practice points in the direction of employer liability
The Occupational Safety Act was revised in 2002, and major changes were made to the law with the EU Framework Directive on the Working Environment. The previously quite concrete Occupational Safety Act was replaced by the current law, which regulates objectives and means, and the basic idea of which is the management of safety as a whole.
There is not a very clear line in legal proceedings regarding occupational accidents today, but the new law specifically emphasizes the employer's responsibility and court decisions now emphasize corporate fines.
